Dear Customer, with your purchase order data transmission, you are declaring you have read and accepted the following general and payment conditions. For this reason, the data transmission entails the total knowledge of the conditions cited below and their complete acceptance.

Once the online purchase procedure is concluded, we invite you to save and keep the present general conditions of sale, you have already examined and accepted.

In order to buy the items you have chosen, once you have viewed the general conditions and the privacy policy, you have to fill in and send the order form and properly conclude the purchase process, input the delivery data and the ones for a possible invoicing, select the favourite payment method and confirm your order. By sending the order, which means a contract proposal, you admit you have examined and completely accepted the present general and payment conditions here transcribed.

We will send you a confirmation email for your order with the ID number, the delivery and invoicing data, the purchased items list and the total amount, including any possible shipping cost.

GENERAL CONDITIONS OF SALE

You can access the address https://www.lanottedellataranta.it (Website from now on) from all over the world.

The ITEMS DETAILS AND FEATURES are available, with the relative codes, on the website.

The visual representation of items, if it is available, usually corresponds to the photograph used in the description card. The image aims just to present the item for the sale and it is not intended to represent perfectly the features and the qualities of the product, considering that it can be different in colour, size and decorations. In case the image and the item sheet are different, please attest to the description of the item card.

With regard to INTELLECTUAL PROPERTIES RIGHTS, the buyer states to be informed that brands, names and distinguishing features, denomination, images, photograph, text, graphics used on the Website or concerning the items are exclusive properties of Fondazione Notte della Taranta Via della Libertà, 66 (Ex Convento dei Padri Agostiniani, Melpignano (LE), (FNDT from now on) and that by accessing the Website and/or purchasing items it does not come any right on the above mentioned properties.

The Website content cannot be reproduced, neither entirely nor partially, moved with electrical or conventional means, modified, or used for any purpose without a prior written consent by FNDT. As concerns the PAYMENT METHODS, the buyer can make the payment of the purchased products and the relative shipping costs by using PayPal.

Once you have confirmed the order, you will be addressed to the PayPal website where you will have the possibility to make your payment with your account, using a credit card or any other method PayPal accepts, and respecting the relative conditions.

Your PayPal data are handled directly by PayPal. The information are send directly to the bank through cryptography systems that prevent third parties to use your shared data. We reserve the right to contact the banking institute that has issued the card, just in case of problems.

With regard to SHIPPING TIMES AND METHODS the orders we receive within the 10.30 am will be processed same day.

We commit to deliver the purchased items by the courier we will communicate to you in the moment your package is leaving. The products will be delivered in Italy within 7 (seven) days, while in Europe within maximum 15 (fifteen) working days starting from the working day following the day in which we confirm your order through confirmation email. In case we are not able to carry out the shipping within the deadline, we will notify you by email, specifying the new shipping date.

The shipping times can vary on basis of the destination Country and other factors we cannot control. In case you decide to pay via bank transfer the shipping days will start from the day in which we receive the payment. The order arrived on Saturdays or Sundays will be processed the following Monday; the orders we will receive on festive days will be handled on the following working day. In any case shipping times are not binding. The delivery service will be realised from Monday to Friday during office hours (9am-6pm), holidays excluded.

All PRICES on the Website represent public issues according to Codice Civile (ex art. 1336), and include VAT and any other tax.

The shipping costs will be calculated and indicated during the purchase procedure and in the recap page of the order. The prices can be modified by FNDT any time, without any notification, it being understood that the charged price will be the same as the one published on the item card at the moment you made your order.

As regards to ITEMS AVAILABILITY provided on the Website, these ones are limited. It is possible that many users buy the same product and that this one will not be available anymore. In this case our customer service will notify the buyer, giving advice on the way to proceed.

We LIMIT OUR RESPONSIBILITY in case of disservice due to extenuating circumstances or malfunctions connected to the use of Internet beyond our own control or of our suppliers. In addition to this we are not responsible for damages, losses or costs suffered after the non-execution of the contract due to causes non ascribable to us, considering the customer has right just to total refund of what corresponded. Moreover, we will not be responsible for a possible fraudulent use of your credit cards by third parties at the moment you pay.

With regard to WARRANTIES AND CUSTOMER SUPPORT METHODS, we will be responsible for any possible damage previously verified and ascribable to us as long as the damage is notified via recorded-delivery letter with advice of receipt to FNDT address or through an email to customercare@lanottedellataranta.it within 8 (eight) days starting from the delivery date, specifying the lot number and the spotted damage.

According to article 12 of Law 70/03, as regards to CONTRACT DISMISSAL METHODS, we inform you that every order is saved in a digital format on the Website server according to security and privacy criteria.

In case the product is damaged, missing, or has big differences from the item you have purchased, we have the authority to ask a photographic proof showing the non-compliance. Once it is verified, we will proceed with a total refund. If the refund would be partial or should not concern the total amount of the order, the shipping costs will not be reimbursed.

FNDR has the authority to reject a complaint in the following cases :

-wrong delivery address, incomplete or unsuitable one, or if something is missing in the address (for example the house number, the name and surname on the doorbell). In these cases we will not be responsible because of our impossibility to deliver the products due to the mistake.

The WITHDRAWAL RIGHT, according to the national and community regulations, provides the buyer with the right to terminate the contract by filling in the form in the footnote (pursuant to the model according to article 49, clause 4 of the consumption code) and sending it to customercare@lanottedellataranta.it or sending an explicit statement to communicate the decision to break the contract.

Once the contract is terminated, the buyer has to return the items within 14 days starting from the date of the withdrawal communication. The shipping cost will be carriage paid, as well the responsibility in case of loss or damage of products in transit.

The withdrawal right is correctly exercised when it respects the following conditions too:

-the form or any other statement has to be transmitted respecting the deadline forecast in these selling general conditions;

- every product is intended to be returned in the original packaging, intact and sealed, and must be undamaged.

If the previous conditions are wholly respected, we will proceed with the refund within 14 days starting from the day in which we will receive the item back. The refund will be carried out using the same payment method the buyer chose to purchase the products, except for a different deal between the parties.

Otherwise, the buyer will not have the right to get any refund by FNDT.

The withdrawal right is implemented on the product as a whole, for this reason if the item is made by different elements, it is not possible to exercise the right just on a single part.

The withdrawal right is considered excluded for product that cannot be returned due to hygienic and sanitary reasons or for items that have been unsealed.

In these cases, FNDT will return the items to the buyer, charging the shipping costs to him.
